 That article doesn't state it, but others have - the aforementioned incident was edited out.

So, the guy will play hell trying to prove it then? Kinda hard for him to obtain footage that was edited out. Videotape would usually be a "case closed" situation, but won't be this time.

 If the footage exists and Sony is asked for it, it would be illegal for them to refuse.  Not to mention the fact that he could locate several hundred witnesses if necessary.  If it happened, then, proving it wouldn't be that hard.  Proving the medical case that this incident triggered whatever medical problems he's complaining about three years later will be the tricky part.  Just because a sloppy reporter printed his one-sided version of the events as fact doesn't mean a judge will think that way.

The reporter hasn't done anything less here than would normally be expected in a little lawsuit piece. Surely people don't expect direct quotations to necessarily be fact. Come on, he's quoting from a lawsuit. Everybody knows those are mostly fiction!
