 The possibility that an extremely stupid person (and as we all know, Ebay is RIFE with stupid people) could think that the presence of Ken's image would imply that Ken was endorsing the particular auction makes me think that the auction would be taken down if a certain Ken were to request that Ebay do so.

What does that certain Ken think?

Considering that the seller isn't putting Ken's words in his mouth, and since he's reputable (according to the feedback rating), I'd say it's okay.

 Believe you me, that doesn't mean jack. All that means is that they do a lot of volume. Most Ebayers are gonna give positive feedback no matter what.

 And of course we all know that eBay's feedback rating is an infallible measure of how reputable a seller is.

That notwithstanding, the feedback rating has nothing whatsoever to do with whether or not it's okay for the seller to use Ken's picture in that manner.  I'm inclined to agree with Chris on this one; if Ken went to eBay and said he didn't want to appear to be endorsing the item, eBay would likely pull it.  But unless and until Ken himself says something, we'll never know.
