Yes you can....

(and this is a sneaky way to bring back the Lucky Case game without having any gambling issues, since it is also a beauty contest vote...you knew NBC would figure out a way to get the phone money back)

You mean, the "premium text message" charge was construed as gambling? Shocked! Shocked, I am!

Nope. Pretty much anything that is as heavily dependent on small print as the "premium text message" racket is firmly entrenched in "scam" territory as far as I'm concerned.

And now a court in Georgia has thrown out a case involving the "DOND" Lucky Case game, more or less saying that a premium text message is not the same as a lottery ticket:

So we're back at Square One--and NBC will probably bring the Lucky Case game back after this contest ends.
